‘Rebel without a cause’ Supreme Court drops contempt case against Manoj Tiwari

The court also expressed "shock" over Tiwari's response that he broke open the locks due to pressure from the "mob" who had reportedly turned violent. In a major relief for Manoj Tiwari, the Supreme Court on Thursday spared the Delhi BJP chief of any punitive action but disapproved his action of breaking the seal of a building under “mob” pressure. The house was sealed by the East Delhi Municipal Corporation (EDMC) in Gokalpuri in September. The court also expressed “shock” over Tiwari’s response that he broke open the locks due to pressure from the “mob” who had reportedly turned violent. We are extremely pained by Manoj Tiwari’s behaviour of taking law into his own hands, the bench said. An FIR against Tiwari, a Member of Parliament from the north-east Delhi constituency, was lodged by the EDMC for allegedly breaking the seal of the premises in Gokalpuri area in north-east Delhi. (Express photo/Abhinav Saha) The bench also ruled that the sealing of the premises concerned had nothing to do with the Monitoring Committee approached by the court and Tiwari’s allegations against the court-mandated committee showed how “low he can stoop”. The committee was not consulted in the case, the court said. An FIR against Tiwari, a Member of Parliament from the north-east Delhi constituency, was lodged by the EDMC for allegedly breaking the seal of the premises in Gokalpuri area in north-east Delhi. In his defence, Tiwari had earlier said that he had not “disobeyed” any orders of the apex court. He had claimed that the EDMC had dragged the monitoring committee in the matter with a sole intention to gather “media glare and publicise” the whole issue. He said that on September 16, when he had gone for a visit in his constituency, he came to know about the sealing of an alleged “illegal dairy”, and when he inquired from EDMC officials about it, they were not ready to offer any satisfactory explanation. He had also claimed that the monitoring committee was set up by the apex court to oversee implementation of orders of the court but it was never the scope of the panel to take actions, in unauthorised colonies since they are protected under the 2011 Act. Accusing the authorities of adopting ‘pick and choose’ method, the MP had questioned as to why no actions had been taken in areas like Okhla, Jamia, Shahin Bagh, Noor Nagar, Johari Farms having five to seven storeyed buildings.
